We wanted to have a short article with some of the frequent questions we get about legal terms and other legal topics.
Are there any contracts with Fourthwall?
No contracts! Stay with us because you want to stay with us, not because you are required! You can leave Fourthwall whenever you want. If you want to close your shop, you can follow this help article: How to close or delete my account/shop?
Who owns the IP of my designs & products?
You do! You keep the IP of the designs and art used to customize your products. We only get permission to use those to fulfill your shop orders - nothing more.
If you use a graphic designer, make sure your agreement gives you full ownership of what they develop for you.
Can I use other people's art or designs for my products?
Yes, as long as you have permission from them. Ideally, written permission saying you can use the designs for commercial purposes. That protects you not just with the artist or owner of the art/design but also in case of a copyright infringement claim, giving you the evidence to dispute that claim.
You are responsible for ensuring that you have the rights to use the artwork and designs you sell.
For any specific copyright questions, we recommend consulting with a copyright lawyer, as we cannot provide legal advice.
Who owns the customer data?
You do! While it's powered by Fourthwall, it is your store and your data; we are your engine. Do note that the customer has ultimate power over their data, and if they email for data deletion, we have to comply as required by regulation (i.e., GDPR).
Something important to note is that we do not sell your fan/supporter’s data or market other people’s products to them. This goes against everything we stand for as your partner.
Who is responsible for chargebacks and payment disputes?
Depends on the product being sold. We help respond to the disputes claims by submitting the pertinent evidence. However, depending on the products/order type, you might be ultimately responsible for the chargebacks and disputes:
- Orders with products from Fourthwall catalog - we are responsible in this case to make sure the order was received as expected. You don't have to worry!
- Orders with self-fulfilled, self-sourced products (products you provide) - we help respond to the dispute claims which is why it is important to upload tracking numbers. However, you are responsible if the dispute claim is lost to cover the chargeback amount and dispute fee ($15).
- Orders with digital products - we help respond to the dispute claims with all the evidence we have including download logs. However, you are responsible if the dispute claim is lost to cover the chargeback amount and dispute fee ($15).
